The City of Vincent is seeking feedback on a proposal to request three existing rights of way (laneways in North Perth and Leederville) be made into roads.

Background

The Minister for Lands has authority under section 56 of the Land Administration Act 1997 (WA) to dedicate as road, land that comprises a private road which the public has had uninterrupted use of for a period of not less than 10 years.

The rights of way in this proposal have been used as laneways for over 10 years. Dedicating the rights of way as roads will not impact adjoining properties which have had uninterrupted vehicle access and will allow for the proper management of the rights of way by the City.

At the 11 March 2025 meeting, Council resolved to provide public notice seeking submissions on the three road dedications.

Details of Rights of Way

Lot 51 (North Perth)

Lot 51 is a privately owned right of way off Haynes Street in North Perth, bounded by Haynes, Charles and Sydney Streets as shown in the plan below.

Dedication of this right of way will enable progressing naming of the right of way which will assist in wayfinding for the residents who use the right of way as the main entry to their properties.

Lot 66 (Leederville)

Lot 66 is a privately owned right of way off Richmond Street in Leederville, bounded by the Mitchell Freeway, Richmond Street and Melrose Street as shown in the plan below.

Dedication of this right of way is in response to Landgate's query to name the right of way. Dedication and naming will improve wayfinding for the properties accessed by the right of way.

Lot 67 (Leederville)

Lot 67 (shown in red) is a privately owned right of way connecting Loftus Street to Fleet Street, flanked by Richmond Street to the south. The western portion (shown in green) of the right of way is a dedicated road, owned by City of Vincent. Refer to the plan below.

Dedication of this right of way will formalise vehicular access to adjoining properties.

This consultation closes 4pm Monday, 5 May 2025.

What will happen next?

After the consultation period has closed, Administration will consider any responses to the public notice period and will include copies of any submissions in our request to the Minister to dedicate the road.

If the request is granted, the road will be dedicated on and from the day on which the relevant order is registered.

The land will come under the care, control, and management of the City, who will maintain the land and any new infrastructure.
