Development Description: Proposed Child Care Premises - Joint Development Assessment Panel (JDAP) Application

Development Application Number: 5.2022.147.1

Development Details:

The application proposes to construct a new Child Care Premises. Key aspects of the proposal are as follows:

  • A two (2) storey Child Care Premises with a mezzanine outdoor play area;
  • The Child Care Premises proposes pedestrian and vehicle access from Loftus Street;
  • The Child Care Premises would accommodate 65 children and nine (9) staff;
  • A total of 19 car parking bays on-site, including three (3) at-grade bays and 16 bays in car stackers; and
  • The proposed hours of operation for the Child Care Premises are Monday to Friday 6:30am to 6:30pm only.

The applicant has submitted the following information/justification in support of the proposal which is included in the community consultation documents:

  • Development Plans
  • Landscaping Plans
  • Planning Report
  • Acoustic Report and Noise Management Plan
  • Transport Impact Statement and Parking Management Plan
  • Environmentally Sustainable Design Report

Application Update and Re-Advertising

The City previously undertook community consultation on the proposal from 7 July 2022 – 5 August 2022.

The City is now undertaking a second round of community consultation to seek comments on the modifications to the development plans and the supporting technical information.

Following the previous community consultation period, the applicant has updated the following:

  • Updated Development and Landscaping Plans, of which the key changes include:
    • Increased setback of the rear stairwell and first floor outdoor play area to 4.5 metres from the western boundary.
    • Increased landscaping along the front, side and rear boundaries, as well as on the first floor outdoor play area.
    • Enclosure of the ground floor outdoor play area with a roof.
    • Provision of a turning bay for cars at the rear of the car parking area. To facilitate this, four (4) at-grade car parking bays along the northern boundary have been replaced with two car stackers (providing four (4) bays)
    • Removal of the second bin store that was previously located along the western boundary.
    • Removal of the 'future crossover' to the right-of-way.
  • Updated Transport Impact Statement (TIS) and Parking Management Plan (PMP).
    • This has been updated in response to concerns relating to traffic and parking. 
    • The applicant has confirmed that they would agree to providing a central median on Loftus Street to restrict access to the proposed Child Care Premises to left-in and left-out only.
  • Updated Acoustic Report and Noise Management Plan.
    • This has been updated in response to concerns relating to noise.

The purpose of the second round of community consultation is to keep interested parties informed of the progress of the application and provide you with the opportunity to re-affirm, retract, modify or provide additional comments in relation to this application. There is no requirement for you to make a further submission on the updated plans and supporting technical information. Any submissions and comments previously provided will still be taken into consideration should you not wish to make a further submission.

Any new comments on aspects of the proposal that remain unchanged can also be included in further submissions.

Final Application Update

On 1 May 2023 the JDAP resolved to refuse the application, the reasons for the decision are available on the JDAP website.

On 23 May 2023 the applicant appealed the decision to the State Administrative Tribunal and on 31 January 2024 the applicant elected to withdraw the appeal. As a result, the decision of the JDAP on 1 May 2023 to refuse the development stands.
