UPDATE - March 2024

Amendment No. 12 has now been approved by the Minster, and was published in the Government Gazette on 27 February 2024. This means that it is now in effect and is operational.

Along with making the Service Station land use a prohibited ‘X’ use within all zones except for the Commercial zone, Amendment No. 12 was also approved with a number of existing Service Stations being listed as an Additional Use.

The effect of Amendment No. 12 is that any planning applications that propose a new Service Station land use within the Mixed Use, Local Centre, Regional Centre and District Centre zones would not be capable of being approved as they are now prohibited. Existing Service Stations that are listed as an Additional Use or that have a current planning approval would continue to retain non-conforming use rights and are allowed to continue operating.

Local Planning Scheme No.2 – Amendment No.12 (Service Stations) Consultation

At its meeting on 13 December 2022, Council endorsed consultation on Local Planning Scheme Amendment No.12. This amendment includes changes to the scheme to prohibit the location of 'Service Stations' in residential and mixed use zones and town centres.

Modification to the permissibility of the use class 'Service Station'

  • Amending Clause 32 of the Local Planning Scheme 'Additional site and development requirements' to include use class 'Service station' is not permitted where the lot on which the service station is located is adjoining or adjacent to a Residential or Mixed use zone.

Following the advertising period open between 9 February to 27 March, submissions on the amendment are now closed.

Community feedback will be considered as part of the recommendation to Council as to whether or not to proceed with the proposed Amendment. All submitters will be notified of the Council process in the coming months.
