Development Details: Public Works Referral - Multiple Dwellings (9)

We have received a referral from the Department of Communities for a public housing development at No. 55 Milton Street, Mount Hawthorn for nine (9) multiple dwellings.

The subject site is owned by the Department of Communities and the development is proposed as public works. Therefore is it exempt from the need for development (planning) approval under the City’s Local Planning Scheme No.2.

However, Section 6(2) of the Planning and Development Act 2005 requires the Department of Communities to seek comments from the City on public works regarding:

  • Their consistency with the purpose and intent of the City’s Local Planning Scheme No.2;
  • Orderly and properly planning; and
  • The preservation of local amenity.

The City is not the decision maker on the development and only provides referral comments back to the Department of Communities who will ultimately make a decision on the development.
