Development Description: Proposed Service Station - Joint Development Assessment Panel (JDAP) Application

Development Application Number: 5.2022.270.1

Development Details:

The application proposes to construct a new Service Station. Key aspects of the proposal are as follows:

Demolition of the existing Service Station and Motor Vehicle Repairs building at No. 41-43 Angove Street and the existing dwelling at No. 45 Angove Street.

  • A total of eight fuel filling positions (4 bowsers) under a solid canopy to provide whether protection. This would be an increase from the current total of three fuel filling positions at the subject site.
  • Vehicle access from Woodville Street, Angove Street and the laneway.
  • A two storey control building fronting onto Angove Street with a retail component at the ground floor level and an office for use by management at the mezzanine level.
  • Proposed 24/7 hours of operation.
  • Six (6) on-site car parking spaces would be provided in the south western corner of the site behind the control building, including 1 ACROD bay.
  • Up to three (3) staff on-site during peak times, between one (1) and two (2) staff on-site during non-peak times and one (1) staff on-site overnight.
  • Associated signage, including a monolith sign on the corner of Woodville and Angove Street which advertises the business operator and petrol prices.
  • Amalgamation of the four existing Lots into one Lot.

Application Update and Re-advertising

The City undertook community consultation for the proposal between 12 October 2022 – 9 November 2022. The City is now seeking to undertake a second round of community consultation to seek comments on the modifications to the development plans and the additional technical information. However, any new comments on aspects of the proposal that remain unchanged can also be included in submissions.

The applicant has provided the following documents:

  • Revised Development Plans, of which the key changes include:
    • An increased setback of 1m to the rear laneway
    • Narrower crossovers
    • Additional verge landscaping
    • Pedestrian/cycle warning signs to crossovers
    • Enhanced footpath connection from Angove Street to front of store
    • On-site EV facilities
    • Relocated refuse enclosure, with sliding gates
    • Changes to raised garden bed on northern elevation of the control building
    • Changes to the canopy feature column adjacent to the laneway
  • Revised Transport Impact Statement (TIS) and a new Traffic Technical Note.
    • These have been prepared to address changes in the access arrangements and proposed City works within the Angove Street and Woodville Street road reserve.
  • A New Emissions Impact Assessment.
    • This has been prepared in response to concerns relating to health.

SAT Application

The City has been notified that the applicant has lodged a review of the decision made by the JDAP to the State Administrative Tribunal (SAT).

As the decision marker, the JDAP will be the respondent in this matter and the City has been invited to participate in the SAT review proceedings.

Information about the SAT process and proceedings can be found on the SAT website at www.sat.justice.wa.gov.au.

The next step is for the matter to be listed for a directions hearing, which has been scheduled for Friday 16 June 2023. The purpose of the directions hearing is to establish how the matter will proceed through the SAT review process.

This may be either through mediation if there is a prospect for resolution of issues, or listing the matter for a hearing where there is no opportunity for mediation. The SAT strongly encourages mediation between the parties.

The City will provide further updates as this matter progresses.
