Development Description: Alterations and Additions to Service Station

Background:

City of Perth History

The site has historically operated as a Service Station since the 1950’s and 1960’s when the land formed part of the City of Perth and was subject to the City of Perth’s planning scheme that was operative at the time.

City of Vincent History

On 12 March 2002 a development application was approved for a change of use from Service Station to Service Station and Vehicle Sales Premises under the City’s then Town Planning Scheme No. 1 (TPS1).

This approval included conditions which limited the number of service station working bays to a maximum of two at any one time. The operation of the Service Station included four refuelling positions as well as a vehicle servicing component.

The definition of Service Station under TPS1 only allowed for the retail sale of petroleum and motor vehicle accessories and did not allow for the retail sale of other products.

The conditions of the previous approval are included below, and did not include a restriction on operating hours:

  1. Compliance with all relevant Environmental Health, Engineering and Building requirements;
  2. All stormwater produced on the subject land shall be retained on site to the satisfaction of the Town's Technical Services Division;
  3. Prior to the first commencement of the use wheel stops shall be installed in accordance with AS290.1;
  4. A maximum of five (5) vehicles shall be displayed for sale at any one time; and
  5. A maximum of two service station working bays shall be operating at any one time.

The subject site was zoned Commercial under TPS1. The City’s current Local Planning Scheme No. 2 (LPS2) replaced TPS1 and was gazetted on 18 May 2018, and changed the zoning of the site to District Centre.

On 27 February 2024 Amendment No. 12 to LPS2 was gazetted. Amendment No. 12 resulted in the Service Station land use becoming a prohibited ‘X’ use in the District Centre.

This means that any applications that propose a new Service Station land use would not be capable of being approved as they are now prohibited.

Non-Conforming Use

As the existing Service Station on the site has a current valid planning approval this would be capable of continuing to operate as a non-conforming use.

All existing uses that are ‘X’ or prohibited uses that have previously operated under a valid planning approval are able to continue operating and under alterations and additions to the development.

The City’s LPS2 requires planning approval for any alterations or additions to a non-conforming use.

The proposed application is separate to the development application that was refused by the Development Assessment Panel on 3 May 2023 and is currently the subject of an ongoing State Administrative Tribunal matter.

Summary of Proposal:

The application that is the subject of this community consultation relates to works to the existing Service Station building at No. 41-43 Angove Street, North Perth.

The proposed works to the existing service station include:

  • New shopfront works to north elevation, including painting and cladding of exterior walls, new entry doors and new shopfront windows in place of existing roller doors.
  • Replacement of the cladding of the existing fuel canopy.
  • Fill in existing roller door on eastern elevation adjacent to Woodville Street, and paint over walls.
  • Existing roof to be painted.
  • Fill in existing window on southern elevation, and paint over walls.
  • Replacement of fuel bowsers and underground fuel tanks.
  • Installation of a new 2.1m high refuse enclosure.
  • Installation of new landscaping areas

Although signage is indicated the applicant has advised that this is not part of the application. The application does not propose any modifications to the existing vehicle access points or change to the number of fuel bowsers.
