Background
At its meeting on 10 November 2023 the JDAP approved a proposed Change of Use to Unlisted Use (Community Purpose) and Alterations and Additions. The minutes from this meeting are available here.
This approval was subject to a number of conditions.
Following the JDAP’s approval the applicant lodged with the State Administrative Tribunal (SAT) for a review of a number of conditions that were imposed.
SAT Process
Following two separate mediation sessions between the parties the SAT issued orders on 19 April 2024 which have invited the JDAP to reconsider the conditions that were imposed.
The JDAP is invited to reconsider its decision on or before 12 July 2024. Associated with this the City’s Responsible Authority Report (RAR) is due to be submitted by 20 June 2024.
Summary of Application
The conditions that are the subject of this review relate to:
- Time limited approval;
- Staff numbers;
- Submission of an amended Operations Management Plan;
- Review and distribution of the Operations Management Plan;
- Timing of deliveries; and
- Stormwater management.
The applicant also seeks to include a new advice note in relation to the provision of an active and interactive façade to Stuart Street.
A comparison of the existing conditions and the applicants proposed modifications is included below with the changes indicated in red.
The applicant has also provided a cover letter which includes justification for the proposed changes as well as an updated Operations Management Plan.
