What's being decided?
We want to hear your feedback on the Restricted Premises - Smoking policy.
Your feedback will shape the provisions in the policy, and the built form and land use outcomes of premises whose primary trade is through the sale and consumption of tobacco and tobacco related products.
Background
Widely accepted scientific research into the effects of tobacco consumption indicates the harmful impacts tobacco consumption has on peoples physical health and more broadly the overall health of our community. Complimenting the City's work in the space of 'Smoke Free Town Centres', a project previously endorsed by Council through its Public Health Plan, the City has developed a local planning policy which aims to provide assessment guidance for premises whose primary means of trade is through the sale and consumption of tobacco related products.
Council endorsed the Restricted Premises - Smoking policy, for the purposes of consultation at its August 2022 Ordinary Meeting of council. The main purposes of this policy are to:
Reduce the number of businesses whose primary purpose is the consumption of tobacco as well as the promotion of tobacco and smoking; and
Ensure that any businesses whose primary purpose is the sale and consumption of tobacco are located in a manner that does not negatively impact the amenity of neighbouring sensitive land uses.
What will the Policy specifically address?
The policy will address existing gaps within the local planning framework, as it relates to some types of premises whose primary trade is based on the sale and consumption of tobacco. It will set a framework for the following types of premises:
Premises who sell smoking related implements and paraphernalia;
Premises who offer the consumption of tobacco products (including shisha bars) on site; and
Some shops that primary sell tobacco and tobacco products (not otherwise exempt from approval under the City's Local Planning Scheme).
