Update

The City of Vincent has adopted the Animal Amendment Local Law 2023 at Council’s 17 October 2023 Meeting.

The Animal Amendment Local Law 2023 was published in the Government Gazette on 7 November 2023 and will be operational from 21 November 2023.

Background

The City of Vincent is seeking public comment on a draft Animal Amendment Local Law 2023. The proposed amendment provides further clarity for owners and occupiers of premises within Vincent wishing to keep cats.

At its 12 October 2021 Meeting, Council approved (Item 9.3) advertising the proposed Animal Local Law 2021. After the advertising period closed, Council approved the making of the Animal Local Law 2022, at its 13 December 2022 Meeting (Item 10.3).

The Animal Local Law 2022 was then provided to the Joint Standing Committee on Delegated Legislation (JSCDL) on 17 February 2023 for their review. The JSCDL is a joint committee of the Parliament of Western Australia, delegated by Parliament, to scrutinise subsidiary legislation.

The process since then has included:

  • On 23 March 2023, the JSCDL advised Council of a number of requirements, one of which was to make the Animal Amendment Local Law 2023 within six months i.e., by 23 September 2023.
  • A report to the Ordinary Council Meeting on 4 April 2023 Agenda Item 10.3 Undertakings Relating to the Animal Local Law 2022 lists the undertakings requested by the JSCDL and Council's proposed response, which was subsequently adopted.
  • At its 25 July 2023 meeting, Council then approved Item 10.2 advertising the draft Animal Amendment Local Law 2023.

Project details

The proposed draft Animal Amendment Local Law 2023 is in response to a direction from the JSCDL.

The draft Amendment provides further clarity about the requirements with which owners and occupiers of premises within the district must comply, in order to keep cats.

The City of Vincent is now inviting comments on the draft Animal Amendment Local Law 2023.

Following this public notice period, any submissions received will be provided to Council for consideration and determination whether to proceed with the proposed Animal Amendment Local Law 2023.
