Update: Approval of Amendment No. 8

Following the conclusion of consultation, the City considered all comments and made a recommendation to Council to proceed with the proposed amendment at its July 2022 Council Meeting.

On 3 February 2023, the Local Planning Scheme No. 2 – Amendment No. 8 was approved by the Minister for Planning, as recommended by Council.

The approved amendment became effective as of its publication in the Government Gazette on 17 February 2023. A copy of this notice is attached to this page.


Background

The City of Vincent previously asked for community feedback on the proposed sale of the City-owned lot at 26 Brentham Street, Leederville.

Since the closure of the previous consultation, the item was presented to Council on 8 March 2022.

As a summary, 87 comments were received with 82 of those being opposed to the potential sale. Students from Aranmore Catholic Primary School submitted a 440-page document filled with letters and drawings expressing their concern over the potential land sale.

Having due consideration for the submissions, Council determined not to advertise the land for sale but to invite offers directly from Aranmore and Rosewood Aged Care first. Amendment 8

At the 8 March 2022 meeting, Council determined to prepare Amendment 8 to Local Planning Scheme No. 2 (this Amendment) to rezone the subject property from Public Open Space to Residential R60. A plan of the proposed rezoning is available below and in the Documents Library.

Why should the land be rezoned?

The report to Council's 8 March 2022 meeting explains that the land is surplus to the City's public open space requirements since Brentham Street Reserve and Britannia Reserve are close by.

The intent of this Amendment is to expand the types of uses that may be permitted on the land.

Currently, the rear portion of the site is reserved for Public Open Space, which means it can only be used as a local park.

By rezoning to Residential R60, the land can still be used as a park but can also be converted to uses that would typically be seen in a residential area such as houses/apartments, home offices, and aged persons dwellings.

The R60 density code sets a deemed-to-comply height limit of three storeys.

In the case of the potential development of grouped dwellings on the site, a maximum of 11 dwellings could be permitted across the entirety of Lot 37 (1784 square meters), however site constraints would likely limit this further.

How is this related to the sale process?

The rezoning process is separate from the proposed land sale.

If the rezoning is completed, this does not necessarily mean that the land sale would proceed.

The City would be able to decide whether to hold the land as Residential R60 while maintaining its current use as a park, or to sell/lease the land.

The City would use the proceeds to establish or improve public open space in other areas of Vincent that need it, as well as improve landscaping around the remainder of Brentham Street Reserve.

Similarly, if the rezoning does not occur, the land could still be sold, but it would negatively impact the site's potential value and development potential.
